BOOKING TERMS & CONDITIONS

Kindly read the IMPORTANT INFORMATION below carefully before you book your trip or any other services with us.
  • When you book a tour or any other services with us, whether by phone or e-mail, you are deemed to have read and accepted our booking conditions, which constitute the entire agreement between you and us. By booking on behalf of other participants, you are deemed to be the designated contact person for every participant included on that booking. This means that you are responsible for making all payments due in connection with your Tour booking, notifying the Tour Operator or your travel agent if any changes or cancellations are required and keeping your party informed. By booking on behalf of another person or persons, you represent and warrant that you have obtained all required consents. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate and the Tour Operator will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.
     
  • These terms and conditions are subject to change at any time, and it is your responsibility to check these terms and conditions regularly in the event of any changes. Continuing to use our travel service after a change is your acceptance of these changes.
  • In these terms and conditions, the words "passenger" or "customer" or "customer" mean the person who agrees to book, purchase, travel, including accompanying minors, and all heirs, successors in the interest and personal representatives. "Company" or the word "we" or "we" refers to Rickshaw Travel Indochina Co., Ltd.
1. VALIDITY.
 
The dates, itineraries and prices are valid from 1st January 2017 to 31st December 2018. Beyond 31st December 2018, dates, itineraries and prices are given for information only.
 
2. RESERVATION STATUS.
 
All services described in the detailed itineraries will be reserved after receipt of your approval and confirmation of the proposal. In the event that some services can not be confirmed, you will be informed immediately and offered with an alternative.
 
3. DEPOSIT AND FINAL PAYMENT.
 
You are required to pay a NON-REFUNDABLE deposit of 30% of the total package cost or USD 150 per person per trip to confirm your reservation (please note that higher deposit fees may apply for some trips).
Unless otherwise agreed by Rickshaw Travel Indochina, final payment or balance is required 45 days prior to departure. If the final payment is not paid on or before the due date, Rickshaw Travel Indochina reserves the right to treat your booking as canceled.
If your booking is made within 45 days of the customer's arrival date, the full amount is required at the time of booking.
Unless, otherwise agreed by Rickshaw Travel Indochina Co., Ltd., the payment of the customer must be made in cash, Western Union, bank transfer or by credit card. A 3% banking fee will be added to the total amount due when using a credit card (Visa, Master Card, American Express).
 
4. CANCELLATIONS:
 
4.1 Cancellation by the travelers.
 
(+) If you cancel part or all of your reservation, a cancellation fee will apply. The effective date of the cancellation will be the date on which the Corporation receives a written notice. Cancellation fees to customers are described as follows:
  • More than 60 days before arrival: no cancellation fee.
  • More than 30 days before departure: We will retain the deposit
  • 30 - 15 days before the departure: 30% of the price of the Tour is canceled
  • 14 - 08 days before the departure: 50% of the price of the Tour is canceled
  • Less than 07 days before departure: 100% of the price of the Tour is canceled
  • For the avoidance of doubt, as some suppliers (airlines, hotels and cruise lines) have cancellation policies that differ from those of Rickshaw Travel Indochina, the cancellation charges may, at our discretion, be adjusted accordingly.
(+) Cancellation of additional services.
  • For additional hotel nights and other additional services booked in connection with the planned itinerary (booking), cancellations will be charged as follows:
  • More than 30 days before the service, the extra costs will be refunded in full.
  • 30 - 15 days before the service: 50% of the price is lost
  • Less than 15 days before the service: 100% of the price is canceled (unless we can negotiate otherwise with the hotel or other suppliers).
4.2 Cancellation by Rickshaw Travel Indochina.
 
We may cancel a trip at any time prior to departure if, due to widespread pandemic, terrorism, natural disasters, political instability or other external events, it is not viable for us to operate the intended trip. If we cancel your trip, you may transfer the paid amounts to another departure date or receive a full refund (not including bank transfer fees or third-party service charges). In cases where the cancellation is due to external events beyond our reasonable control, the refunds will be less sunk costs. We are not responsible for incidental charges that you may incur as a result of your booking, including, but not limited to, visas, vaccinations and travel insurance or non-refundable flights.
 
(*) For this particular clause, it is advisable to cover the cases mentioned by your own travel insurance.
 
 
5. CLAIMS AND REIMBURSEMENT OF UNUSED SERVICES.
 
No refunds or exchanges may be made with respect to accommodations, meals, sightseeing tours, transportation or any other services included in the Tour Prize but not used by the Tour Member.
For claims to be taken into account, they must be received in writing by Rickshaw Travel Indochina within 30 days of the end of the program and must be accompanied by supporting documentation.
Any adjustment taken into account will be based on the actual price of the services concerned and not on a daily basis. Rickshaw Travel Indochina accepts no responsibility for claims that are not received within 30 days of the end of your travel program.
 
6. CUSTOMER OBLIGATIONS.
 
The Customer is responsible for checking the travel documentation to ensure that the dates are correct and must inform Rickshaw Travel Indochina immediately of any errors or omissions.
It is the Customer's responsibility to ensure that his travel documentation is in order, eg. passport and visa
If the customer does not arrive on the agreed date for the Tour, Rickshaw Travel Indochina has the right to consider the Tour as having been canceled by the Customer.
The Customer agrees to comply with the instructions given by the crew of Rickshaw Travel Indochina and agrees to indemnify the Company against any loss or injury suffered as a result of non-compliance with the instructions of the crew.
The customer agrees not to damage the accommodation and if such damage occurs, agrees to pay the owner for the price of the repair or replacement thereof.
 
7. POLICY OF THE CHILDREN.
 
Children under 2 years of age travel for free and pay 50% of transport costs, 2 to 5 years 50% tour and 90% air transportation, 5 to 11 years 75% for tour & airline complete loads. 12 years and over = 100% (billed as an adult).
 
8. EARLY CHECK-IN.
 
Early check-in or late check-out are not included in the rates. Most hotels allow mid-afternoon check-in. If you wish to have your room ready for immediate check-in on arrival; Rickshaw Travel Indochina will be able to arrange this for a fee. The detail indicated on the exclusion list of your itinerary.
 
9. AGE AND HEALTH.
 
All travelers under the age of 18 must be accompanied by an adult who is responsible for the daily care of the child.
We are able to provide details on mandatory health requirements; However, we are not medical experts. It is your responsibility to ensure that you get appropriate and detailed medical advice at least two months before your trip for the latest health requirements, recommendations for your destination and all costs. When you do not do this and you are not allowed to enter a country, or you suffer bodily injury or death, we are not responsible for any costs, losses or damages you incur and we will not reimburse you not the cost of any unused portion of your travel arrangements.
 
10. TRAVEL DOCUMENTATION.
 
All clients must be in possession of a valid passport and any necessary visas or permits at the beginning of the trip. All these documents are the sole responsibility of the customers. Your travel advisor can help you apply for the necessary travel documents upon request. Rickshaw Travel Indochina declines any responsibility for failure of customers to obtain appropriate documents.
 
11. ACTIVE ELEMENTS AND ACCEPTANCE OF RISK.
 
Clients should consider all risks associated with international travel and become familiar with the health requirements applicable to the regions they intend to visit. The client is solely responsible for the verification of safety and security conditions, vaccination and other health requirements of governments in countries visited or in transit.
On adventure routes, active elements are integrated into the tour. To enjoy the visit as planned, a minimum level of fitness is required to participate. The level required would be equivalent to what is achieved through routine daily exercise such as golf, jogging, energetic walking, tennis, etc. Activities during the tour could include (but are not limited to) trekking, hiking, off-road walking, cycling, kayaking and navigating rough terrain. If you have any questions or require clarification on a specific tour, please ask for details at the time of booking.
You acknowledge that the nature of the trip is adventurous and that participation involves some degree of personal risk. You will visit places where political, cultural and geographical attributes present greater dangers and physical challenges than those present in our daily lives.
We use information from foreign government ministries and reports from our own contacts to assess whether the route should work. However, it is also your responsibility to review all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of the review of this information and you agree that you are aware of the personal risks inherent in such a trip.
 
12. FLEXIBILITY.
 
You appreciate and recognize that the nature of this type of travel requires great flexibility and that you should provide alternatives. The planned itinerary for each trip is representative of the types of activities envisaged, but it is understood that the itinerary, schedules, itineraries, amenities and mode of transportation may be changed without notice due to circumstances or circumstances. local events.
 
13. PHOTOGRAPHY.
 
During your program, Rickshaw Travel Indochina reserves the right to take photos during the execution of any program or part of a program and to use them for promotional purposes. By making a reservation with our company, tour participants agree to allow their images to be used in such photographs. Participants who prefer not to use their images are asked to identify themselves to their guide / tour guide at the beginning of each itinerary.
 
14. COMPLAINTS.
 
If you are not satisfied with any of the services provided by Rickshaw Travel Indochina and wish to make a complaint about a stay, please inform your local guide or travel advisor so that similar problems do not occur. reproduce during the rest. of your trip, giving us a reasonable opportunity to rectify things.
Rickshaw Travel Indochina will act as an intermediary between customers and other service providers such as air, train, boat and hotels in case of claim.
Notwithstanding the foregoing, you may notify us in writing no later than 30 days after your return to the port of departure. Any complaint received after this period will not be accepted.

15. INSURANCE.
 
Clients must be covered by comprehensive travel insurance. It is the customers' responsibility to read his insurance policy before traveling with Rickshaw Travel Indochina and to ensure that the insurance system provides the customer with the required level of coverage. Travel insurance may very well become a pre-requirement for entry from many governments/destinations in the post-Covid era and the recommend minimum amount  is 100,000 USD.

This includes trip cancellation, emergency medical evacuation and other coverages (more cases in section 17 below). Airline schedules, train schedules and local conditions may affect accommodations and itineraries. If this occurs, Rickshaw Travel Indochina will endeavor to replace an appropriate arrangement of equivalent value.
 
16. LIMITATION OF LIABILITY.
 
We enter into a contract with a network of suppliers, government agencies and individuals to assist in the conduct of our travel as an agent for these third parties. We are not responsible for the acts and omissions of these third parties.
To the fullest extent permitted by law:
Liability for any loss, death, injury or damage that you may suffer (directly or indirectly) in connection with or arising from your participation in a trip, or any breach of booking conditions, is excluded.
You release us from all liability, as well as our officers, employees, agents and representatives, and expressly waive any claim you may have against us due to or in connection with your participation in a trip.
Any conditions or warranties that would be implicitly included in these Booking Conditions (Implied Warranty) are excluded.
To the extent that an implied warranty can not be excluded, our liability for the implied warranty is limited to (at our sole discretion): (i) the provision of a similar trip at an equivalent value; or (ii) a refund of the total amount we received from you as part of your booking.
Any claim on your part is excluded to the extent that it is an indirect or consequential loss, loss of profit or economic loss of any kind, or consequential, special, punitive damages. or copies.
 
17. FORCE MAJEURE.
 
If, as a result of a "Force Majeure" (defined below), the Rickshaw Travel Indochina is obliged to reduce, modify, extend or cancel the visit, the customer will not be free to claim compensation or otherwise for any loss resulting from the said reduction, modification, extension or cancellation of the visit.
"Force majeure" means natural disasters, adverse weather conditions, fire or any other destruction of any vessel, craft or vehicle used in connection with a holiday, the destruction or damage to a holiday home, riots, acts of war, agitation, exercise of legislative or governmental action, municipal or military authority or other, strikes, collective action, requisition of equipment, mechanical breakdown, fuel breakdown, insolvency or default of any carrier or service related to the tour, fraud committed against the company.
